Safety Regulations for Temporary Pools

A "seasonal" swimming pool is one that is designed to be set up and used for the summer season before being taken down and stored. These pools are purchased from stores and set up by individuals without licensing or permits.

LOCATION: Outside or open-air swimming pools shall be located with a minimum six (6) foot side yard set-back or three (3) feet from the rear yard property line. Pools may not be placed in a front yard (both street frontages on a corner lot are considered front yards). The pool may not be placed in an easement. 

ENCLOSURES: Private swimming pools, hot tubs, and spas containing water more than 24 inches in depth must be completely surrounded by a fence or barrier at least 48 inches in height above the finished ground level measured on the side of the barrier away from the pool. Gates and doors in such barriers shall be self-closing and self-latching. Where the self-latching device is less than 54 inches above the bottom of the gate, the release mechanism shall be located on the pool side of the gate. Self-closing and self-latching gates shall be maintained such that the gate will positively close and latch when released from an open position of six (6) inches from the gatepost. No existing pool enclosure shall be removed, replaced, or changed in a manner that reduces its effectiveness as a safety barrier.

ELECTRICAL SAFETY: Overhead electrical lines and network powered broadband communication systems may not pass over the swimming pool or the area measured ten (10) feet horizontally from the pool on the ground. Phone lines are allowed provided they are located a minimum of ten (10) feet above the pool. All electrical installations necessary to operate your private seasonal swimming pool shall be installed in accordance with the current adopted National Electrical Code. 

MAINTENANCE: The owner of every private swimming pool shall be responsible for maintaining the pool in a clean and sanitary condition and shall prevent breaks in the pool and water from the pool from overflowing onto adjacent public or private property.
